ReloSale Terms of Use

1. General Provisions
These ReloSale Terms of Use (hereinafter referred to as the "Terms") govern access to and use of the website, mobile version, applications, APIs, chats, forms, services and other functionality of the ReloSale platform (hereinafter referred to as the "Platform" or "ReloSale").
By using the Platform, registering an account, posting listings, browsing content, interacting with other users or otherwise using the functionality of ReloSale, the user confirms that they have read these Terms, understand their content and agree to comply with them.
If the user does not agree with these Terms in whole or in part, they must not use the Platform.
These Terms apply to all users, including private individuals, sole proprietors, legal entities, agents, brokers, agencies, professional sellers, landlords, tenants, buyers, service providers and visitors of the Platform.
2. Platform Status
ReloSale provides an information and technology infrastructure for publishing, searching, viewing, promoting and managing listings, as well as for communication between users.
Unless expressly stated otherwise in separate terms, ReloSale:
- is not a seller, buyer, landlord, tenant, service provider, customer, agent, broker, commission agent, attorney or any other party to a transaction between users;
- does not guarantee the conclusion of a transaction, the performance of obligations by users, their good faith, solvency, or the existence of rights to goods, property or services;
- does not act as a custodian, carrier, payment agent, escrow provider, notary or guarantor, unless such status is expressly established by separate terms.
The Platform does not control and is not responsible for the content of agreements between users, the quality of goods and services, the legal status of properties, the actual condition of assets, the legal status of real estate, the validity of documents, licences, permits and powers of users, except in cases expressly provided for by applicable law.
3. Definitions
For the purposes of these Terms, the following definitions apply:
Account — a user's registered account on the Platform.
Listing — information posted by a user about a product, service, property, job, rental, sale, purchase, exchange, search or other offer.
User Content — texts, images, videos, audio, documents, reviews, messages, comments, descriptions, titles and other materials posted by a user.
Paid Services — any paid features of the Platform, including promotion, priority placement, highlighting, subscriptions, advertising tools and other services.
Professional Seller / Business User — a user who posts listings as part of entrepreneurial, agency, commercial, professional or systematic activities.
Prohibited Content — goods, services, materials and methods of using the Platform that are prohibited by these Terms, the Platform rules or applicable law.
4. Registration and Account
To access certain features of the Platform, the user must create an account.
The user must:
- provide accurate, correct and up-to-date information;
- not impersonate another person;
- not use another person's data without lawful grounds;
- promptly update account information;
- maintain the confidentiality of login credentials.
The Platform may request verification of an email address, phone number, identity, business user status, listing rights, as well as other information and documents, if necessary for security, legal compliance, internal trust & safety procedures or category-specific rules.
Unless otherwise permitted by the Platform, each user is allowed to use only one account. Creating multiple accounts to circumvent restrictions, manipulate ratings, promotions, moderation, complaints, verification or other features is prohibited.
The user is responsible for all actions performed through their account, unless they can prove that access was obtained by third parties without their knowledge and that the user took reasonable measures to protect the account.
5. Access and Right to Use the Platform
ReloSale grants the user a limited, revocable, non-transferable, non-exclusive right to use the Platform in accordance with its intended purpose, these Terms and other Platform documents.
The user does not acquire any rights to the source code, databases, interfaces, trademarks, design, domain names, algorithms, catalogue structures, data compilations or other elements of the Platform, except for the expressly granted right to ordinary use of the service.
6. Posting Listings
The user may post listings only in respect of goods, services, properties or offers that:
- are permitted by applicable law;
- do not violate the Platform rules;
- belong to the user or are posted by the user on lawful grounds;
- are described accurately, in good faith and do not mislead other users.
The user must keep their listings up to date and promptly update, edit, unpublish or close listings that are no longer current.
ReloSale may establish additional requirements for specific categories, including real estate, rentals, automobiles, jobs, services, international listings, business listings and other sections.
7. Communications Between Users
The Platform may provide built-in chats, contact forms, contact buttons, protected numbers, masked calls, email relay, push notifications and other communication tools.
The user must use communication channels in good faith and must not engage in:
- spam;
- threats, insults, discrimination, harassment;
- fraudulent schemes;
- phishing, social engineering, solicitation of codes, passwords, OTPs or other data;
- circumventing the Platform's technical restrictions;
- imposing third-party services in circumvention of Platform rules.
ReloSale may use automated and manual tools to detect abuse, security threats, fraud and other violations to the extent permitted by law.
8. Prohibited Conduct
The user is prohibited from:
- using the Platform for unlawful purposes;
- posting prohibited goods, services, offers or content;
- publishing false, misleading, incomplete or information that conceals material terms;
- using automated data collection, scraping, crawling, parsing, indexing, data extraction, data harvesting, mirroring, spidering or similar tools without the Platform's written permission;
- copying the listings catalogue, database, category structure, interface elements, texts, photographs, compilations, reviews or other Platform materials on a mass or systematic basis;
- circumventing technical protection measures, limits, anti-bot mechanisms, rate limits, paywalls, category restrictions or moderation systems;
- creating multiple accounts, transferring an account to third parties, buying or selling accounts;
- using fake reviews, artificial activity, inflating views, saves, responses, complaints or ratings;
- posting listings that lack independent consumer value, including lead generation, pseudo-listings, bait listings, client search disguised as a listing, redirecting to external sites, messengers or storefronts in circumvention of Platform logic;
- distributing malicious code, viruses, trojans, backdoors, miners or other malicious components;
- infringing the rights of third parties, including intellectual property rights, image rights, name rights, trade secrets, data rights and privacy;
- interfering with the operation of the Platform, conducting stress tests, vulnerability scanning, reverse engineering or other actions without written permission.
9. Rights to User Content
By posting User Content on the Platform, the user confirms that they hold sufficient rights to such content and are entitled to grant ReloSale the right to use it to the extent necessary for the operation of the Platform.
The user grants ReloSale, for the duration of the content's placement and for a reasonable period after its removal, a non-exclusive, royalty-free, worldwide right to use, store, reproduce, adapt, format, process, translate, publish, display, distribute and otherwise make the content available to users and partners of the Platform for the purposes of:
- operating the service;
- publishing and promoting listings;
- displaying in search results and recommendations;
- placement in advertising surfaces and partner networks;
- preventing abuse, archiving, reviewing complaints and resolving disputes.
The user retains rights to their content to the extent such rights belong to them under law.
10. Platform Intellectual Property
All rights to the Platform, including source code, databases, interface, design, logos, trademarks, texts, compilations, analytical models, algorithms and other elements, belong to ReloSale or are used on lawful grounds.
Use of such materials outside the ordinary functionality of the Platform is permitted only with the written consent of the rights holder.
11. Paid Services
The use of certain Platform features may be subject to a fee. General matters relating to balance, charges, tariffs, refunds, bonuses, restrictions and termination of paid services are governed by a separate document — the ReloSale Paid Services, Balance and Refunds Terms.
If a user orders a paid service, they are required to review the relevant terms, pricing, duration, restrictions and refund rules before purchasing.
12. Verification and Checks
ReloSale may, but is not obliged to, verify accounts, phone numbers, email addresses, identities, professional seller status, listing rights, addresses, property documents, vehicle documents, licences, company registration data and other information.
The presence of a badge, mark, "verified", "trusted", "business", "agency" or similar designation does not constitute an absolute guarantee of a user's good faith, the legal purity of a transaction, the quality of a product or service, or the absence of risks.
13. Reviews, Ratings and Reputation Tools
The Platform may provide review, complaint, rating, reputation indicator, activity counter and status mechanisms.
The user may not manipulate such systems, use fake accounts, incentivise false reviews, threaten with reviews, extort concessions or otherwise abuse reputation tools.
ReloSale may moderate, hide, reject or remove reviews if they violate the Platform rules, the rights of third parties or applicable law.
14. Moderation, Restrictions and Enforcement Measures
ReloSale may, at its discretion and to the extent permitted by law:
- review listings and user actions manually and automatically;
- reject, hide, restrict, technically edit or remove listings;
- temporarily suspend access to certain features;
- restrict impressions, promotion, communications or fund withdrawals;
- request additional information and documents;
- flag accounts and listings with warnings;
- apply temporary or permanent account suspensions;
- disclose information to competent authorities and rights holders in cases provided for by law.
Such measures may be applied, in particular, where there are indications of:
- violation of the Terms or other Platform documents;
- fraud, abuse, security threats or circumvention of rules;
- inaccurate data;
- spam and manipulation;
- complaints from users, rights holders, partners, banks, payment providers or government authorities;
- publication of prohibited content.

15. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis, unless otherwise required by mandatory provisions of applicable law.
ReloSale does not guarantee:
- uninterrupted, continuous and error-free operation of the service;
- the absence of technical failures, delays, errors, data loss or service interruptions;
- that the user will achieve any commercial result, number of responses, views, transactions, sales, tenants, buyers or other metrics;
- compliance with user expectations;
- the absence of violations by other users.
16. Limitation of Liability
To the maximum extent permitted by law, ReloSale shall not be liable for:
- transactions, failed transactions, negotiations, losses, lost profits and other consequences of user interactions;
- the quality, legality, safety, authenticity, fitness, completeness, condition, origin and delivery of goods, services and properties;
- acts, omissions, representations and promises of users;
- User Content and information in listings;
- temporary unavailability of the Platform, technical errors, cyberattacks, actions of third parties, telecommunications operators, providers, hosting providers, payment systems and other contractors;
- indirect, incidental, punitive, special or consequential damages.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
17. Indemnity
The user agrees to indemnify and hold harmless ReloSale, its affiliates, employees, contractors and representatives against losses, expenses, claims, demands, fines and costs, including reasonable legal defence expenses, arising from:
- the user's violation of these Terms or other Platform documents;
- the user's posting of unlawful, rights-infringing or misleading content;
- the user's actions in connection with the use of the Platform;
- third-party claims related to the user's listing, product, service, property, review or transaction.
18. Governing Law and Dispute Resolution
Unless otherwise required by mandatory provisions of the law of the user's country of residence or local annexes to these Terms, disputes between the user and ReloSale shall be subject to preliminary resolution through a claims procedure by sending a request to the Platform's official contact address.
If the dispute is not resolved through negotiation, it shall be heard by a court or other competent authority at the place of registration of the Platform operator, unless mandatory provisions of applicable law require otherwise.
For users in certain countries or regions, the Platform may publish special country-specific terms.
19. Changes to the Terms
ReloSale may at any time amend, supplement, update or replace these Terms in whole or in part.
The updated version shall take effect from the date of its publication on the Platform or from another date expressly stated in the document.
Continued use of the Platform after changes take effect constitutes the user's acceptance of the new version of the Terms.
20. Termination of Use
The user may cease using the Platform and delete their account in the manner provided by the service functionality, provided there are no outstanding obligations, open disputes, security restrictions, data retention obligations or other grounds for temporary retention of information.
ReloSale may terminate, restrict or suspend the user's access to the Platform in whole or in part on the grounds provided for by these Terms, other Platform documents or the law.
21. Miscellaneous
If any provision of these Terms is found to be invalid, unlawful or unenforceable, this shall not affect the validity of the remaining provisions.
ReloSale's failure to act in the event of a user's breach of these Terms does not constitute a waiver of the right to require compliance in the future.
These Terms are drawn up in English. The Platform may publish translations into other languages. In the event of discrepancies, the version expressly designated by the Platform as the primary version for the relevant jurisdiction shall prevail.
